In an identical application, arrears may also be used to refer to interest payments to bond holders that were not paid at the time when they were due. In this article I have written how the concept of arrears works, and how it is possible for companies to find themselves in arrears having dividend and interest payments.

Investment in company using Serial bonds

For investing within a company the serial bond is often one of the mechanisms . As soon as serial bonds get matured, they accrue an amount of interest that is due to the holder of the bond. As the bond reaches maturity, the interest is calculated and the bondholder gets the payment.

However, if at the time the bond reaches maturity a company is unable to meet the payments on the interest, then the corporation may approach the bondholder having a plan to revise the payment schedule, or to make arrangements to pay off the interest by a certain future date. In either of the two scenarios, the company will be considered in arrears until that the bondholder is given a full interest payment.

Dividend payment on Stocks

In a similar scenario to the mature bond, stocks yield a return and on a recurring basis dividends are paid to the shareholders. When a company is unable to pay a dividend payment on time, then the amount of the payments that is left behind is considered to be in arrears.

As with the bond issue, shareholders may be asked by the companies to work with them and to accept an alternate payment schedule for the dividends. Once that the payment schedule is in place, and that first agreed upon dividend payment has been received by the shareholder, the company is not considered to be in arrears any longer.

Arrears are uncommon for Businesses

When someone is experiencing  the business management, then they may observe that during the course of a fiscal year it is not that much uncommon for businesses to experience some sort of arrearage. Often, innocuous matters are the causes of the state of arrears, such as a delay in calculating the interest or dividends that are due.

Usually in a very short period of time this sort of delay is resolved, what it means is that rather than in longer increments of time, the state of arrears may be measured in days or weeks.

Frequency of arrearage occurrence

Still, the frequency with which the arrearage occurs with a given corporation as well as the average duration that a payment remains in arrears is important to consider. Frequent slow payments to investors, may show a sign that the organization is not as financially stable as it should be, and specifically if it takes months for the payments to process.

Involvement of Complicated financial transactions in Fraud Cases

Complicated financial transactions are involved in many fraud cases that is conducted by ‘white collar criminals’, business professionals with specialized knowledge and criminal intent. By an unscrupulous investment  broker an opportunity to purchase shares in precious metal repositories may be presented to clients, for example. Such a credibility is given to him by his status as a professional investor, which can lead to a justified believability among potential clients.

When does a Fraud Victim can sue a Broker?

If a stranger approached you and asked you for ten thousand dollars to invest in a vending machine business, then you would most likely walk away. But if a well-dressed man by whom an investment seminar has been held and he has mentioned his success in the vending machine world, you might rely on his expertise and perceived success for making the decision to invest in his proposal.

After that a few months have elapsed and the person has not contacted you or hasn’t delivered any vending machines, then you might reasonably assume that fraud has occurred. In court of law, you are required to testify that your investment decision was partially based on a reliance on his expertise and experience.

The element of fraud which tends to prevent successful prosecution is the obligation to investigate. It is the responsibility of a potential investors or customers that they should fully investigate a proposal before any money exchanges hands.

What if the fraud case is not reported to Court on time?

If an investors failed to take appropriate measures at the time of the proposal then it can seriously weaken a fraud case in court later. It can be claimed by the accused that the alleged victim had every opportunity to discover the potential for fraud and he had failed to investigate the matter thoroughly.

Fraud victims should consult a legal professional

What does SIPC covers?

Cash and securities such as stocks and bonds  are covered by the SIPC covers which are held by a brokerage firm. If financial trouble is experienced by the firm and these assets go missing, efforts will be made by the SIPC to recover them, they usually  do this by liquidating the troubled firm with the assistance of a trustee who is appointed by a federal court. The SIPC will restore securities to all clients, when a firm fails. Cash funds are distributed to the claimants after liquidation of a firm, although the cap is $100,000 US. After liquidation if the firm still has funds leftover and compensation is complete, then SIPC will distribute the excess funds to individuals who had claims over the funding cap. The guarantee will not be given by SIPC that the restored securities will have the same value that they did before, due to market fluctuation.

Protects investors from unauthorized trades

The investors are also protected by the SIPC from unauthorized trades, although investors must be proactive about proving that a trade was unauthorized. Due to this reason, the investors are encouraged by SIPC encourages  to clearly log unauthorized trades on paper and in written communications with their brokerage firm. The account statements should also be frequently checked by the investors  and they should immediately register complaints about irregular or unauthorized activity.

Investors should do business with SIPC members Firms

It is important for investors to do business with only those firms that are members of the SIPC. Misleading names or language are used by many investment firms which might lead clients to believe that they are SIPC members, and at their website the SIPC maintains a database of valid members. The SIPC also has a phone hot line on which investors can call in order to determine the member status of a firm. Firms which are included in the members of the SIPC include “member SIPC” on their literature, along with the SIPC logo.

Rise in the German Ifo

A bigger-than-expected rise in the German Ifo November business climate index has helped the euro. The index rose to 93.9, a level that has not seen since the collapse of Lehman Brothers last year. This has lifted optimism that Germany’s recovery can gain momentum.

Euro

After falling as low as $1.4889 by 1239 GMT, the euro EUR= was up 0.1% at $1.4975. On Monday it hit a one-week high of $1.5001 but has recently struggled to hold above $1.50.

Traders cited options with a strike price of $1.5000 and $1.5050 which were set to expire later in the day.

Euro against Yen

The euro was down 0.3% at 132.68 yen against the yen EURJPY=R.

Dollar index

The dollar index was steady at 75.064 .DXY. This is the index by which the performance of the greenback against a basket of six other major currencies is tracked.

Standard and Poor’s raised concerns about some major banks

After a report on Monday by U.S. ratings firm Standard and Poor’s raised concerns about the health of some major banks, the dollar and yen gained against riskier currencies.

Yen become firm

The yen secured firmness, having the dollar down 0.4% to 88.58 yen JPY=, after earlier touching a six-week low of 88.56 yen on trading platform EBS.

Australian dollar and New Zealand dollar

The Australian dollar was down 0.4% at $0.9203 AUD=D4, it is lower than a 15-month high of $0.9407 last week, whereas the New Zealand dollar NZD=D4 fell 0.7% to $0.7281.

Greenback’s gains reversed

The remarks helped in encouraging a broad rally in global stocks, oil, gold and higher-yielding currencies that reversed the greenback’s gains from late last week.

Position of Major Currencies

In New York on Monday morning, , according to EBS via CQG the euro was at $1.4988 from $1.4851 late Friday. It has been noted that the dollar was at Y88.80 from Y89.00, whereas the euro was at Y132.97 from Y132.26. The U.K. pound was at the position of $1.6621 from $1.6491. The dollar was at CHF1.0089 from CHF1.0183.

The Dollar Index

The Dollar Index, was at 75.024 from 75.647. This index tracks the greenback against a trade-weighted basket of six currencies.

Gold and oil prices become Higher

Overnight gold hit a fresh high record, while oil jumped to as far as $78.72. It has been indicated by futures that U.S. stocks are set to open higher. Better-than-expected economic data in Europe has also supported the euro.

Purchasing managers’ index data

In November purchasing managers’ index data from the euro zone has shown a rise to a two-year high, having the composite index including the manufacturing and services sector that has climbed to 53.7 from 53 in October.

Canadian dollar gains

Monday morning as the currency benefits from the overall weakness in the U.S. dollar the Canadian dollar is markedly higher. The U.S. dollar is trading at C$1.0557 from C$1.0704 late Friday.

Canadian retail sales rose 1%

An added boost has been secured by the Canadian unit from news Monday that Canadian retail sales rose 1% in September to C$34.9 billion (US$32.6 billion).

Higher equities and commodity prices

It has been said by the TD Securities that higher equities and commodity prices and the broad-based U.S. dollar selloff are all supporting the Canadian currency.
